Members of FOP Lodge #89 shall enjoy the benefit of the following coverage pursuant to the terms of the Retainer Agreement executed by and between the FOP and the Law Firm (“Schlachman, Belsky, Weiner & Davey, P.A.”):
- Unlimited advice and consultation regarding District Command/IAD/SIRT investigations, whether the member is a Respondent or Witness;
- Representation at any and all Interrogations where the Member is a Respondent;
- Representation at any and all Administrative Hearing Boards where the Member is a Respondent (please note that representation at one-person Administrative Hearing Boards shall be provided by Steven Sunday, Esquire, or, if unavailable or subject to a conflict of interest, by any attorney selected at the sole discretion of FOP Lodge #89);
- In the event of termination of employment following a Member’s Administrative Hearing Board, representation at any and all hearings arising from a Petition for Judicial Review before the Circuit Court for Prince George’s County;
- Representation during any officer-involved shooting;
- Unlimited advice and consultation regarding any departmental issue not otherwise handled by the FOP’s labor attorney.
FOP Lodge #89’s Prepaid Legal Services Agreement extends coverage to the following individuals: the member, the member’s spouse, the member’s children (natural or adopted) under the age of eighteen (18) years, and/or any handicapped child of the member—regardless of age—who resides with the member and is wholly dependent upon the member for support and maintenance.
The following items, while covered pursuant to the aforementioned agreement, may require the payment of certain filing fees, service fees, or fees related to the production of trial materials. Please note that these fees are the sole responsibility of the member receiving representation. A schedule of court filing fees may be accessed at www.mdcourts.gov.
- Unlimited advice and consultation on any legal matter. In the event the matter falls outside the expertise of the Firm’s legal professionals or the jurisdiction in which the Firm’s attorneys are licensed to practice, the Firm shall assist the member in identifying counsel that may be of assistance.
- Preparation of Last Will and Testament, Advance Medical Directives, and Financial Power of Attorney. This includes simple trust provisions for the member’s minor children, but excludes estate planning for tax purposes. This does not include representation during Probate.
- Domestic Relations and Family Law: the Firm shall provide to members representation in the following matters:
- Preparation of Marital Separation Agreements;
- Representation during both Uncontested and Contested Divorce Proceedings;
- Representation during both Uncontested and Contested Annulments;
- Representation during Child Custody cases occurring prior to or concurrent with an action for Divorce;
- Representation during Adoption Proceedings; and
- Representation during Change of Name Proceedings.
- Criminal Law: the Firm shall provide to members representation in the following matters:
- Representation during any District Court criminal or traffic proceeding in which the member is a Defendant;
- Representation during any Circuit Court juvenile proceeding in which the member’s minor child is a Respondent;
- Representation during any Motor Vehicle Administration proceeding in which the member is a Respondent, to include matters involving administrative penalties for DUI/DWI, accumulation of points, and/or violation of insurance requirements relating to financial responsibility.
- Civil Actions: the Firm shall provide to members representation in the following matters:
- Representation during any District Court civil proceeding in which the member is a Defendant;
- Representation during the following District Court civil proceedings in which the member is a Plaintiff:
- Cases involving the assertion of excessive interest and/or late charges;
- Illegal debt collection actions;
- Furniture and other personal property repossession;
- Enforcement of warranties; and
- Consumer rights matters related to credit ratings.
- Real Estate Transactions: the Firm shall provide to members representation in the following matters related to the primary residence of the member (“primary residence” is defined as that residence where the member resides for the majority of a calendar year and shall exclude resort or vacation homes):
- Representation of the member at settlement of the sale or purchase of their primary residence, specifically excluding the performance of title searches and conducting of settlement;
- Review and/or preparation of contract(s) for the sale or purchase of the member’s primary residence;
- Representation during any landlord-tenant disputes involving the member’s primary residence; and
- Review of lease(s) for the member’s primary residence.
- Miscellaneous: the Firm shall provide members with the preparation of simple legal documents (i.e., demand letters, purchase agreements), notary services, and the establishment of birth certificates.
- Reduced Fee Provisions: the firm shall provide members with representation in items not otherwise enumerated herein at a rate of $250/hour, subject to the receipt of a retainer fee as agreed upon by the Firm and the member.
- Plaintiff’s Civil Representation and Worker’s Compensation: in any civil matter in which the member retains the Firm as Plaintiff’s counsel, the Firm shall assess a reduced contingency fee of 25% of the settlement or, if the matter necessitates the filing of a lawsuit, 33 1/3% of the gross recovery. Our firm additionally offers a reduced fee on all Worker’s Compensation cases.
